§1General Provisions
This document (the "MED Terms") constitutes Additional Industry Rules within the meaning of the PaidFor.io Terms of Service and applies to all Campaigns designated as PaidFor MED and to the Experts taking part in them.
The MED Terms are made available to the Expert before acceptance of the first Invitation in the MED module, and to the Sponsor before the conclusion of a contract concerning a MED Campaign. Acceptance of an Invitation in the MED module constitutes acceptance of the MED Terms.
The essence of the model in MED. The Reward is due solely for devoting time, genuinely reviewing the material, and providing an honest, independent professional judgement — never for prescribing, ordering, applying, recommending or purchasing any product. A critical opinion is paid just as much as a positive one.
§2Definitions
- Medical Expert
- a User (Participant) within the meaning of the main PaidFor.io Terms of Service who practises a medical profession, in particular: a physician, dentist, nurse, midwife, pharmacist, laboratory diagnostician, physiotherapist or paramedic — holding a valid professional licence or an appropriate entry in the relevant register.
- PWZ
- a professional licence number (PWZ) — the right to practise a profession, or an equivalent professional credential confirmed by an entry in the register maintained by the relevant professional self-governing body.
- Authorised Person
- a person authorised to issue prescriptions or a person engaged in the trade in medicinal products within the meaning of the Polish Pharmaceutical Law (Prawo farmaceutyczne).
- Medicinal Product
- a medicinal product within the meaning of the Polish Pharmaceutical Law (Prawo farmaceutyczne), including prescription-only (Rx) and over-the-counter (OTC) products.
- Medical Device
- a medical device within the meaning of the applicable medical device legislation.
- Sponsor Materials
- all offer materials provided by the Sponsor as part of a MED Campaign — including presentations, recordings, product characteristics, research data and informational and promotional materials.
- Sponsor
- a Company (Sponsor) within the meaning of the main Terms, commissioning a MED Campaign — in particular a marketing authorisation holder, its representative, a manufacturer of medical devices, or a supplier of software or services for the healthcare sector.
§3Medical Experts and Verification
Participation in MED Campaigns is reserved for verified Medical Experts. The Operator verifies in particular: identity, the profession practised, the professional licence number (PWZ) or an entry in the relevant register (including the registers maintained by NIL, NIPiP, NIA, KIDL and KIF), specialisation, and — where relevant to the Campaign — the place and nature of professional practice.
A Medical Expert is obliged to inform the Operator without delay of any suspension or loss of their professional licence (PWZ), a change in the scope of their credentials, a prohibition on practising their profession, or any other circumstance calling into question the accuracy of their Profile. Participation in a MED Campaign while concealing such a circumstance constitutes a material breach of the Terms.
The Operator may restrict a given Campaign to selected professions, specialisations or roles (e.g. only physicians of a specific specialisation), in accordance with the Sponsor's brief and the requirements of the law.
§4Scope of MED Campaigns
MED Campaigns may concern, in particular: Medicinal Products, Medical Devices, software and technology for the healthcare sector, equipment, services, and organisational solutions for medical facilities.
A Campaign concerning a prescription-only Medicinal Product may be addressed exclusively to Authorised Persons. The Operator ensures that access to such a Campaign is technically restricted to Medical Experts verified as Authorised Persons; the Sponsor is responsible for correctly defining the audience in the brief.
A Session within a MED Campaign consists of reviewing the material and providing an independent professional opinion. It does not constitute medical advice concerning a specific patient, a treatment consultation or a healthcare service.
§5Sponsor's Obligations and Liability
The Sponsor bears sole responsibility for the content and legal status of the Sponsor Materials. In particular, the Sponsor represents and warrants that:
- the Sponsor Materials comply with the law, including — where they constitute advertising of a Medicinal Product — with the requirements of the Polish Pharmaceutical Law (Prawo farmaceutyczne) and its implementing acts, including as to content, required information and the audience;
- materials concerning a Medicinal Product are consistent with the Summary of Product Characteristics and do not promote off-label indications;
- it holds all rights and consents required to use the Sponsor Materials in the Campaign;
- it performs, on its own account, all documentation, record-keeping and notification obligations connected with the advertising of its products, where such obligations arise under the law;
- the audience of the Campaign indicated in the brief complies with the regulations governing the advertising of the product concerned.
The Operator acts as the technical organiser of the Campaign: it selects and verifies Medical Experts, provides the Session mechanism and organises settlements. The Operator is not the author of the Sponsor Materials, does not carry out any substantive or legal review of them, and bears no responsibility for their content or advertising status.
The Sponsor shall indemnify the Operator and cover the reasonable costs of defence in the event of third-party claims or regulatory sanctions arising from the content, legal status or manner of use of the Sponsor Materials, to the extent permitted by law.
The Operator may refuse to launch a Campaign, suspend it or terminate it if it has reasonable doubts as to the compliance of the Sponsor Materials with the law or with these Terms — without incurring liability towards the Sponsor for the consequences of such a decision, subject to settlement of the work already performed.
§6Professional Independence and the Nature of the Reward
The Medical Expert's Reward constitutes market-rate remuneration for the time devoted, the expertise contributed and the intellectual service performed (reviewing the material and providing an opinion). Its amount corresponds to the reasonable value of the Expert's work and is not linked to any prescribing, purchasing or recommendation decision.
In particular, the Reward does not constitute and may not be construed as: a benefit in exchange for prescribing, using, recommending or purchasing any product; a prohibited inducement within the meaning of the regulations on the advertising of medicinal products; or a benefit connected with a public function held.
The Medical Expert retains full professional independence. Participation in a Session does not oblige them to make any clinical or purchasing decision, and the content of their opinion does not affect the amount of the Reward.
Where legislation, industry codes or the policies of the Expert's employer require disclosure of the benefit received, the disclosure obligation rests with the Expert; at the Expert's request, the Operator will issue confirmation of the service performed and of the amount of the Reward.
§7Specific Prohibitions and Professional Secrecy
Within MED Campaigns, the following in particular is prohibited:
- disclosing patient data or any information enabling the identification of a patient;
- passing on information covered by professional secrecy (medical, nursing, pharmacist or other) or by the trade secrets of a healthcare provider or employer;
- requesting from the Expert, or disclosure by the Expert of, non-public purchasing, tender or pricing data of a facility, where its disclosure would be unlawful;
- the formulation by the Sponsor of questions aimed at obtaining a prescribing commitment, a declaration of prescribing or a declaration of purchase;
- presenting a Session or Feedback as medical advice, a clinical trial, a medical experiment or an observational study.
The Medical Expert's Feedback constitutes a professional opinion on the material and the solution — it does not constitute a therapeutic recommendation for any patient.
§8Product Safety and Adverse Events
PaidFor MED Sessions do not serve to collect product safety data. However, if in the content of the Feedback a Medical Expert provides information that may constitute a report of an adverse reaction to a Medicinal Product or an incident involving a Medical Device, the Operator will pass that information on to the Sponsor without delay.
The performance of obligations in the field of pharmacovigilance and incident reporting is the sole responsibility of the Sponsor as the marketing authorisation holder or manufacturer. The Sponsor will provide the Operator with an appropriate contact channel for passing on such information.
§9Camera and Presence Verification
In MED Campaigns the webcam serves solely to confirm the Expert's presence and identity in real time during a Session. The camera feed is not recorded, captured or stored, is not shared with the Sponsor and is not subject to biometric analysis (in particular, no facial recognition is used).
Verification of genuine engagement is additionally based on interaction with the material: control questions, open-ended questions and measurement of playback progress. The Sponsor receives the verification result and the content of the Feedback — never the camera feed.
The Expert is informed of the rules governing the use of the camera before accepting an Invitation. Refusal to consent to the use of the camera may prevent participation in a given Session if its conditions provide for presence verification; this does not affect the ability to take part in other Campaigns whose conditions do not provide for such verification.
§10Settlement with Medical Experts
The Reward is settled, according to the option indicated in the Invitation or in the Expert's Profile:
- on the basis of an invoice issued by an Expert conducting a professional practice or business activity, or
- on the basis of a civil-law contract concluded with the Operator — in the case of Experts not conducting business activity; in such a case the Operator performs the withholding agent obligations arising under applicable law.
Payment is conditional on the provision of the data required for tax settlements and any applicable reporting (including tax residency and tax identification number), in accordance with the main Terms.
§11Conflicts of Interest
In addition to the obligations arising from the main Terms, a Medical Expert is obliged to disclose to the Operator, before accepting an Invitation, in particular: participation in tender or purchasing committees concerning the Sponsor's products, holding the position of a regional or national consultant, participation in the Sponsor's clinical trials, material financial ties with the Sponsor or its competitor, and the holding of any public function.
The Operator may exclude an Expert from a given Campaign if the disclosed circumstances could undermine the independence of the opinion or expose any party to a breach of the law.
§12Final Provisions
In matters not regulated herein, the PaidFor.io Terms of Service, the Privacy Policy and Polish law apply. Amendments to the MED Terms are made in the manner provided for amendments to the main Terms.
The MED Terms are effective as of 4 August 2026.
